Federal Anti-Spam Bill Not Enough; Will Result In Wave of "Compliant Spam" Says Permission Email Software Pioneer Mike Adams

Tucson, AZ - November 24, 2003 - Statement from Mike Adams, President & CEO, Arial Software LLC, developer of leading permission email software used by business and government:

We can thank California for passage of the federal anti-spam bill. Why? Because the California bill proposed such stiff penalties that it motivated direct marketers (and the DMA in particular) to support far less intimidating anti-spam legislation at the federal level which -- no surprise -- pre-empts State anti-spam laws.

Regardless, we need federal anti-spam legislation, and while this new bill offers far less than what myself and others in the legitimate permission email business would like to see, it is indeed better than no law. As I and other permission email software firms have argued for several years now, spam needs to be outlawed and spammers need to be put out of business for good. Nothing less is acceptable.

Unfortunately, this federal law, while passed with the best of intentions, will accomplish no such thing. Even after this bill goes into full effect, the spam will continue to flow into the inboxes of Americans everywhere. This new breed of spam, however, will now be 100% legal. It will be what I call, "compliant spam," because it fully complies with federal law.

In this spam, the headers are not forged, the subject line is not misleading, there's a fully functioning unsubscribe link, and yet the email (which you never signed up for in the first place) is still screaming at you to buy the latest, greatest enlargement device or prescription drug. This sort of email fully complies with federal law -- a fact that will become obvious in 2004 when Internet users across the country begin to ask, "Why am I still getting spammed?"

Clearly, we need a better law. While this anti-spam legislation addresses the most fraudulent forms of spam, it also sadly legitimizes an entire class of email solicitations that most people still consider spam.
